Terms of Service

1) Overview

These Terms govern your access to and use of Photav.io (the “Platform”). By using the Platform you agree to these Terms.

Role: We operate a marketplace & tooling platform. Suppliers are independent businesses responsible for their services.

2) Eligibility & Accounts

• You must be legally capable of entering binding contracts in your jurisdiction.
• Provide accurate information and keep credentials secure; you are responsible for your account activity.
• We may refuse, suspend, or terminate accounts to protect users and comply with law.

3) Supplier Accounts

• Suppliers must provide accurate business details, pricing, availability, and comply with applicable laws (permits, insurance, tax).
• Suppliers are responsible for the quality, safety, and legality of services and content.
• Subscription/plan fees (where applicable) must remain current to avoid limits or suspension.

4) Listings & Content

• No unlawful, misleading, infringing, or harmful content.
• You grant Photav.io a worldwide, non-exclusive, royalty-free license to host, display, and promote your content within the Platform and our marketing channels solely to operate and promote the marketplace.
• We may edit or remove content that violates these Terms or law.

5) Bookings, Quotes & Contracts

• Quotes, contracts, and payment schedules (deposit/milestones/final) are between the couple and the supplier. Our tools facilitate, but we are not a party unless explicitly stated.
• Suppliers must honour agreed terms; clients should review details before paying.

6) Payments, Fees & Payouts

• Payments are processed by third-party providers; holds/chargebacks/compliance reviews may occur per provider rules.
• Platform/feature fees (if any) are disclosed at checkout or in plan terms.
• Payouts may require KYC and verified bank/sub-account details with the provider.

We do not store full card numbers. Taxes are the responsibility of suppliers and/or customers as applicable.

7) Cancellations & Refunds

• Each supplier defines its policy (subject to consumer law).
• Refunds, if any, are processed per supplier policy and payment-provider rules.
• We may assist but are not obliged to resolve all disputes.

8) Acceptable Use

• No spam, scraping, reverse engineering, malware, or attempts to bypass security.
• No illegal content, hate speech, or IP infringement.
• Automations/integrations must respect rate limits and security.

9) Intellectual Property

• Photav.io design and software are owned by us (or licensed) and protected by IP laws.
• Supplier content remains the supplier’s; the license grant is as in Section 4.
• Trademarks/logos require written permission.

10) Privacy

Your use of the Platform is subject to our Privacy Policy (POPIA/GDPR-aware).

11) Disclaimers

The Platform is provided “as is” and “as available”. We do not guarantee continuous availability or that suppliers will meet expectations. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of Liability

To the maximum extent permitted by law, Photav.io is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our total liability for any claim relating to the Platform will not exceed the greater of (a) amounts paid to us for the feature at issue in the prior 6 months or (b) ZAR 1,000.

13) Indemnity

You agree to defend, indemnify, and hold harmless Photav.io and its personnel from claims arising out of your misuse of the Platform, your content, or your breach of these Terms or law.

14) Suspension & Termination

• We may suspend/terminate for violations, fraud/safety risks, non-payment, or legal requirements.
• Upon termination, licenses granted to you end; Sections 8–13 survive as relevant.

15) Changes

We may modify or discontinue features and update these Terms; continued use after notice means you accept the changes.

16) Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of courts in (insert city). Mandatory local consumer laws prevail where required.

17) Miscellaneous

• Severability: unenforceable terms do not affect the rest.
• Assignment: you may not assign without consent; we may assign in M&A or asset sale.
• Notices: by email, in-app, or site posting.
• Entire Agreement: these Terms plus referenced policies.
